Should the child's mother face charges instead seeing as she was 'in charge' of both children?

I do not think the 10 year old should be charged with manslaughter. I think 10 is too young to watch a 3 month old. The mother had older kids, aged 15 and 16. I can't understand why she didn't ask one of them to watch the baby instead. If they were not available then she has to make proper arrangements for child care while she's not home. I think this is negligent on her part, but I don't think she should be charged with manslaughter. I don't think the other kids should lose their mother. Perhaps she should go through a child safety and caring class of some sort or with a social worker with Children and Families. This is such a tragic story.

Oh my, how heartbreaking. I do not know what the answer is, but what an awful situation.

Heck yes. The mom totally needs to be charged. In addition to the daughter being charged (not sure about manslaughter) because she obviously at that age knew she was hurting the baby. You leave your kid with an adult and the adult lets the 10 year old take care of it and you don't get justice? Uh Uh.

McCausland said he couldn't comment on whether charges could be brought against the sitter.

I think either I've misunderstood the story or there have been some inconsistencies in the reporting. +

Anyway, she is 10 years old. I think the best route would be for intensive counseling to see what's going on with her and help her with any issues she may be having. She's so young to ruin her life. I know she killed the baby, but I don't seriously think she comprehended what she was doing. Plus she was on medication herself, behavior altering meds. ADHD meds can have awful side effects. In the article, it stated the baby was fussy that night. I bet she tried to calm the baby down by giving the baby her own medication and was having such a difficult time handling the fussiness. I know parents who have a very hard time managing fussy babies. Three month olds can be hard to cope with.

So now as this story says, the babysitter wasn't the mother of the baby and the baby's mother didn't leave the baby with the 10 year old. The adult baby sitter should be charged with manslaughter. She was not taking care of the baby and therefore allowed her to be killed. All of the bruising etc in my opinion couldn't happen without hearing something. I can't imagine how it's possible for a 10 y/o to cover the mouth and punch the baby at the same time. I think some screaming would have been able to be heard.

So yes I'm for charging the adult babysitter but not the 10 year old.

What a nightmare. How heartbreaking....

The mother of the ten year old should be held responsible, I think. The mom of the baby left the baby with the adult, not the ten year old daughter. The crib should have been in the mom's room if anywhere, not in the ten year old's room. What the ten year old did was horrific, but she should not have been left alone with a three month in the first place. So sad for everyone involved.

Sorry I just can't help but think there has to be more to this story. It just doesn't add up. How would the 10 year old have given the baby her prescription medicine? A baby that age would have been only given a bottle so it just seems a little farfetched that the 10 year old would think of putting the medicine in her bottle to give it to her. The whole thing just doesn't make sense.

Ditto this. I don't agree with charging the 10yo. I don't believe that kids are born with that kind of propensity for violence & abuse, it's learned from experience. She obviously needs lots of counseling, for a lot of things, not just the fact that she's responsible for a baby's death, and I see no good in putting her through the justice system at this young age.

She could have put a tablet in the baby's mouth which the baby sucked on.

I totally agree. The baby was fussy and she put the crib in the room with the 10 y/o instead of consoling the baby herself. She just wanted the baby gone. For all we know (and a big assumption) is that she forced the 10 y/o deal with her. So she did.

IMO, I think the adult sitter should be charged with manslaughter. Like most of you have said, she was the adult in charge and should have been keeping a closer eye on the baby. The 10 year old I would say knew she was doing wrong to the baby, but probably didn't realise she was going to cause the baby's death. Therefore, manslaughter is too much and the child should have some councelling!
